Terms & Conditions

Background:

BRAU Timber Pty Ltd (“BRAU”) is a leading Melbourne based importer and wholesaler of high-quality flooring products and distributors of high quality birch and poplar plywood.

Prior to agreeing to these terms and conditions the customer is strongly advised to fully research their specific flooring needs to develop an understanding of their requirements.

The terms and conditions are legally binding and can only be varied by written agreement.

Acknowledgement:

The customer acknowledges and agrees that BRAU has explained the product being sold, the price and any specific issues.

Pricing:

Once a quotation is accepted by the customer and the deposit paid this constitutes acceptance of these terms and conditions.

The agreed price is as stated on the Tax Invoice provided by BRAU.

BRAU can give notice to the customer at any time up to fourteen (14) days prior to delivery of a price increase which is beyond its reasonable control and this binds the customer.

A deposit determined at the absolute discretion of BRAU is required to be paid by the customer on acceptance of the quotation.

Time is of the essence for payment of the products and will be stated on the Tax Invoice. If no time is stated then payment is due on delivery of the products.

Accepted payment is by cash, cheques, credit card, direct deposit, bank transfer, or any other manner agreed.

All prices are GST exclusive and the customer is responsible for the payment of GST.

The customer is responsible for the payment of any late payment fees incurred by BRAU.

Amendments to terms and conditions:

BRAU reserves the right to amend these terms and conditions at any time. Any amendments shall be effective immediately upon notification on the website. The continued use of the website following such notification or purchase of products thereafter will represent agreement by the customer to be bound by the terms and conditions as amended.

Installation Liability:

BRAU is not liable and does not provide any warranty for any installation defects relating to its flooring and plywood products.

No Representations:

BRAU does not warrant or represent the accuracy, completeness or suitability for the intended use of any product or any information on the website.

All information on the website is of a general nature only and is not intended to constitute professional advice. The website may contain information that includes the views or recommendations of others that are not necessarily BRAU’S views.

The customer should make their own enquiries to check if the information on the website is accurate, complete and suitable for the intended use.

Statutory Warranties:

To the fullest extent permitted by law, BRAU’S liability under any guarantee, condition or warranty (including, without limitation, any guarantee, condition or warranty of merchantability, acceptable quality, fitness for purpose or fitness for disclosed result), or any other right or remedy, under any legislation or implied into these terms and conditions by any legislation (“Statutory Warranties”) is specifically excluded.

Where BRAU is liable under any Statutory Warranties, and any legislation avoids or prohibits provisions in a contract excluding or modifying the application of, or exercise of, or liability under, such Statutory Warranties, BRAU’S liability for any breach of such Statutory Warranties shall be limited, at BRAU’S option, to one or more of the following: –

  • if the breach relates to goods: the replacement of the goods or the supply of equivalent goods; the repair of such goods; the cost of replacing the goods or of acquiring equivalent goods; or the cost of having the goods repaired.
  • if the breach relates to services, the supplying of the services again or the cost of having the services supplied again.

The customer acknowledges and agrees that reliance by BRAU on this limitation of liability is fair and reasonable in all the circumstances.
